This website is owned by Wind Industrial EIRELI, a private legal entity registered with CNPJ no. 03.351.783/0001-46, with headquarters and legal venue at Rua Julieta Simões de Oliveira, 595, Bairro Industrial Norte, CEP 89295-000, in the city of Rio Negrinho, State of Santa Catarina (SC), hereinafter referred to simply as “WIND”.

When collecting and using any personal data provided on our website, WIND acts, most of the time, as the controller of this information, as defined by the Brazilian General Data Protection Law (LGPD) (Federal Law No. 13,709/2018). For this reason, we are responsible for defining what happens to such data, as well as for protecting it.

1. What data we collect

Below we indicate the situations and the data we may collect:

We may collect personal data about you when you register to submit your résumé/CV at the Wind Industrial link, including, but not limited to, the following:

  • Education level;

  • Email address;
  • Residential and/or business address;

As a rule, we will collect such personal data when you provide it to us.

We may also collect personal data freely provided by the data subject when sending an email to contato@wind.ind.br and contacting us by phone at +55 74 3203 2900.

While browsing the platform, data may be collected even if you are not registered on our website, such as IP address; information about the device used for browsing; geolocation information (country, state, and city) of access; among others.

We do not collect sensitive data

Under no circumstances do we carry out any processing activity involving sensitive data. For your information, sensitive data includes data on racial or ethnic origin, religious belief, political opinion, membership in a union or organization of a religious, philosophical, or political nature, data concerning health or sex life, genetic or biometric data, when linked to a natural person.

We do not collect children’s data

The information made available through WIND’s digital channels is not intended for children and adolescents. For our hiring processes for permanent positions, candidates must be of legal age and fully capable. For our young apprentice program, our system may also receive résumés/CVs from adolescents aged 14 (fourteen) years and older. Therefore, we do not collect or process, under any circumstances, personal data from children.

2. Legal bases and purposes for processing

In general, we will collect and process your personal data, among other purposes, to communicate and interact with you (if you consent to receiving newsletters and contacts) and to recruit new talent for our team (if you apply for a job opening).

In cases where the processing of your personal data is based on your consent, you have the right to revoke your consent at any time, which will not affect (i) the lawfulness of processing based on your consent before the revocation; or (ii) the lawfulness of processing based on other legal grounds.

3. Cookies and monitoring technologies

We may use monitoring technologies and artificial intelligence to collect information about activities performed on the WIND website in order to:

  • Technical functions: identify errors and usage issues, control website traffic, identify returning users and their usage sessions;
  • Personalization: modify the website according to the user’s navigation, adapting browser type, language, and location settings. Segment content based on browsing history and preferences;
  • Monitoring: track and collect user behavior data to generate performance metrics;

The personal data subject has the right to obtain from WIND, at any time, upon formal request, information regarding their data.

WIND will have 15 days to respond to data subject requests. Requests will be reviewed as provided by current legislation and, for legal reasons, some requests may not be fulfilled.

Data subjects, according to the LGPD, may exercise their rights through:

I. confirmation of the existence of processing;
II. access to the data;
III. correction of incomplete, inaccurate, or outdated data;
IV. anonymization, blocking, or deletion of unnecessary, excessive, or unlawfully processed data;
V. portability of data to another service or product provider, upon express request, in accordance with the national authority’s regulation, observing commercial and industrial secrets;
VI. deletion of personal data processed with the data subject’s consent;
VII. information about public and private entities with which the controller has shared data;
VIII. information about the possibility of not providing consent and the consequences of refusal;

5. Changes to this Policy

Whenever there is a change in the processing of your personal and browsing data, our Privacy Policy will be updated, and we will notify you through one of the communication channels you provided during registration (email, SMS, WhatsApp, and others).

6. With whom we may share your data

The information collected will only be shared when necessary in the following cases: (i) protection in the event of a dispute; (ii) with competent judicial, administrative, or governmental authorities, by court order or request from the competent authority; (iii) with companies providing technological and operational infrastructure, such as payment intermediaries and cloud information storage service providers, anti-fraud analysis companies.

We clarify that we will never sell our customers’ personal data to other companies.

External hyperlinks do not constitute WIND’s endorsement of the linked websites/environments or the information, products, or services contained therein, except when they are also owned by WIND.

It is also very important that you know that we will never send electronic messages or postal mail requesting data confirmation, or with attachments that may be executed (extensions: .exe, .com, among others), or links for any downloads.

The data protection officer is the person appointed by WIND to act as the communication channel between the controller, data subjects, and the National Data Protection Authority (ANPD), when it is formally established.

8. Legislation and Jurisdiction

This policy shall be governed, interpreted, and enforced in accordance with the laws of the Federative Republic of Brazil, especially Law No. 13,709/2018, regardless of the laws of other states or countries. If any provision is deemed illegal or illegitimate, the remaining valid conditions shall remain applicable.

The jurisdiction of the District of São Bento do Sul, State of Santa Catarina, is elected to resolve any dispute or controversy involving this document.
